Wills and Advance Personal Plans

Wills

We can help put together wills with clear instructions on what you would like to happen after you pass away including distribution and transfer of assets, bequests, and funeral arrangements.

Probate, administration and disputed estates

We can help you with all aspects of estate planning and the administration of estates after a loved one’s passing, including wills, power of attorney, probate, and disputed estates.

Advance Personal Plans

Advance Personal Plans are the Northern Territory’s version of an advanced care directive and enduring power of attorney, sometimes referred to as a ‘living will’.

We can assist you to prepare your Advance Personal Plan, including your future health, financial and life choices should you be unable to make decisions for yourself. If you wish, you can appoint decision-makers to make choices on your behalf if you lose your decision-making capacity.

An Advance Personal Plan only takes effect when you lose decision-making capacity while you are still alive. It does not replace your will.

Probate and estate administration

We offer a comprehensive estate administration assistance. If your loved one has passed away with a will, you will need to apply for a grant of probate in order to sort out their affairs and deal with their assets and liabilities. We will prepare the application for probate and advise you regarding your duties as an Executor.

If someone dies without a will, and has assets and liabilities that need to be dealt with, we can help you apply for Letters of Administration.

If you’re not sure what to do, or the deceased person has only a few small assets, there are other simplified processes we can assist you with. We are also experienced in dealing with superannuation companies and life insurance claims.

Disputed estates and family provision claims

We can assist with all types of estate disputes, including if you have been left out of a will, or are concerned the will is invalid or was made under duress or by someone lacking testamentary capacity. There are time limits on these kinds of disputes so don’t delay.
